On August 17, the owner of Bumpy’s Polar Freeze in Schenectady, New York, was ordered to pay $4500 for violating the civil rights of peaceful Black Lives Matter protestors whom he made false claims against.
According to the Associated Press, Attorney General Letitia James filed a lawsuit against David Elmendorf in March after allegedly threatening “a crowd of roughly fifty peaceful protestors with a “.22-caliber air rifle.”
Besides being a menace, he called the police and falsely claimed that there were “20 armed protestors who were threatening to shoot him.”
Elmendorf also referred to Black protesters as “savages.”
The lawsuit stated that “Elmendorf physically and verbally threatened a group of Black protesters who stood peacefully on the porch of a private house near Bumpy’s.”

The racist entrepreneur was also accused of violating the protestor’s rights to peacefully protest by threatening and harassing them.
Elmendorf was being mandated to pay $500 each to nine protesters he harassed, for a total of $4,500.
Apart from the mandatory order, Elmendorf has also been banned from making future threats against people based on their race and is barred from brandishing a deadly weapon within 1,000 feet of a peaceful protest.
Due to current events, Elmendorf is working in a different state indefinitely.
“Those who make racist and violent threats will be held accountable by my office with the full weight of the law,” James said, according to The Hill.
“There is zero tolerance for harassment, intimidation, or violence of any kind against anyone in New York.”
“We must continue to remain vigilant against hate and bias in our communities, and I encourage anyone with information about a potential hate crime to contact my office,” James added.
Elmendorf’s lawyer, James Mermigis, called the accusations “categorically false” and said his client’s name was smeared.
